Terms of Service

These Terms of Service ("Terms") govern access to and use of Aksusnet, including our websites, dashboards, organization workspaces, learning portals, billing flows, and related services (together, the "Service").

By creating an account, accessing an organization workspace, starting a trial, purchasing a subscription, or using the Service, you agree to these Terms. If you use the Service on behalf of a company or organization, you confirm that you have authority to bind that organization to these Terms.

1. What Aksusnet provides

Aksusnet is a software-as-a-service learning workspace that helps organizations create, manage, and track internal courses, learning materials, quizzes, progress, certificates, and related learning activity. Each organization may have its own workspace, users, roles, learning content, progress records, and billing context.

2. Accounts and organization workspaces

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account.

Organization owners and administrators are responsible for:

  • inviting and managing users;
  • assigning appropriate roles and permissions;
  • ensuring that uploaded or entered content is lawful and appropriate;
  • managing billing, plan selection, and subscription status;
  • handling internal user access when users leave the organization.

You must notify us promptly if you believe your account or organization workspace has been accessed without authorization.

3. Eligibility

You may use the Service only if you can legally enter into a binding agreement and are not prohibited from using the Service under applicable law.

4. Acceptable use

You may not use the Service to:

  • violate applicable laws or regulations;
  • infringe intellectual property, privacy, publicity, or other rights;
  • upload unlawful, harmful, abusive, discriminatory, or misleading content;
  • attempt to gain unauthorized access to the Service, another tenant, another account, or our systems;
  • bypass security, rate limits, tenant isolation, payment controls, or access restrictions;
  • reverse engineer the Service except where legally permitted;
  • use the Service to distribute malware, phishing content, spam, or deceptive material;
  • use automated scraping, excessive crawling, or abusive automation without our written permission;
  • resell, sublicense, or commercially exploit the Service except as allowed by your plan or a written agreement.

We may suspend or restrict access if we reasonably believe use of the Service violates these Terms, creates security risk, causes operational harm, or exposes us or others to legal liability.

5. Customer content

"Customer Content" means learning materials, courses, modules, units, quizzes, text, files, images, organization data, user records, and other content submitted to the Service by you or your organization.

You retain ownership of Customer Content. You grant us a limited right to host, process, transmit, display, and back up Customer Content only as needed to provide, secure, maintain, and improve the Service, comply with law, and enforce these Terms.

You are responsible for Customer Content and must ensure that you have all necessary rights, permissions, and legal bases to upload, process, and share it through the Service.

6. Learning records and user data

The Service may process learning progress, quiz results, course completion status, certificates, activity logs, user roles, and similar records. Organization owners and administrators may be able to view and manage this information for users in their organization.

Organizations are responsible for informing their users how learning data will be used internally.

7. Subscriptions, billing, and taxes

Paid plans are billed according to the selected plan, billing cycle, currency, and price shown at checkout or in the billing interface. Unless stated otherwise:

  • subscription fees are charged in advance;
  • prices exclude applicable taxes unless shown otherwise;
  • subscriptions renew automatically until cancelled;
  • cancellation takes effect according to the plan and billing settings shown at the time of cancellation.

8. Free plans and trials

We may offer free plans, free trials, beta access, promotional credits, or early-access functionality. We may modify or discontinue these offers at any time, subject to applicable law and any written agreement with you.

9. Plan limits and fair use

Your plan may include limits such as number of users, organizations, courses, storage, features, or usage volume. We may enforce plan limits, require an upgrade, restrict usage, or contact you if usage materially exceeds normal or permitted limits.

10. Service availability and changes

We aim to provide a reliable Service, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, security work, outages, third-party provider issues, or events outside our control.

We may modify, add, or remove features over time. We will not knowingly remove material paid functionality without reasonable notice unless needed for security, legal compliance, abuse prevention, or operational integrity.

11. Security

We use reasonable technical and organizational measures designed to protect the Service. However, no system is perfectly secure.

12. Third-party services

The Service may integrate with third-party providers, including hosting, email, authentication, payment, database, storage, and infrastructure providers. Third-party services are governed by their own terms and policies.

13. Intellectual property

We and our licensors own all rights in the Service, including software, design, systems, branding, trademarks, documentation, and non-customer content. These Terms do not grant you ownership of the Service or our intellectual property.

14. Feedback

If you provide feedback, ideas, or improvement requests, we may use them without restriction or compensation, provided we do not disclose your confidential information or Customer Content in violation of our obligations.

Our processing of personal data is described in our Privacy Policy and Data Use Policy.

16. Suspension and termination

You may stop using the Service at any time. You may cancel paid subscriptions according to the Refund and Cancellation Policy.

We may suspend or terminate access if you violate these Terms, payment is overdue, use of the Service creates security or legal risk, we are required to do so by law, or continued service provision becomes impractical or unlawful.

17. Disclaimers

The Service is provided "as is" and "as available" to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation unless such warranties cannot be excluded under applicable law.

18. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities.

To the maximum extent permitted by law, our total liability for claims relating to the Service is limited to the amount you paid for the Service during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

19. Consumer rights

Nothing in these Terms limits rights that cannot be waived under applicable consumer protection law. If you are a consumer, mandatory rights under your local law continue to apply.

20. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the Service, by email, or by posting an updated version. Continued use of the Service after changes take effect means you accept the updated Terms.
